ITC to Investigate Apple in Patent Case

Creative Technology Ltd. said the International Trade Commission (ITC) will investigate a patent infringement complaint filed against Apple Computer Inc., according to the AP.

The complaint, jointly filed in May by Creative Technology and its subsidiary Creative Labs Inc., alleges that Apple's iPod and iPod Nano infringe a patent covering the user interface of Creative's Nomad and Zen digital media players.

In its complaint, Creative said Apple is violating the Tariff Act of 1930 by importing into the U.S. iPods manufactured outside the country that infringe Creative's patent. The company is asking the ITC to block their importation.

The ITC said that within 45 days of the investigation's launch it would set a target date for completion of the investigation. Apple has already filed two patent-related countersuits against Creative Technology.
