Whirlpool/Maytag Merger May Be Challenged

Bloomberg reports today that the U.S. Department of Justice (DOJ) is assembling evidence that may be used for a court challenge to the Whirlpool/Maytag merger. Bloomberg's anonymous source familiar with the DOJ investigation points to an increased level of activity among lawyers with the Justice Department indicating concerns that Whirlpool Corporation's proposed acquisition of Maytag Corporation might be anticompetitive. Officially, the DOJ would not comment.

On Tuesday, the proposed merger was cleared by the Competition Bureau of Canada. By agreement between Whirlpool, Maytag and the Antitrust Division of the DOJ, the companies will not close the transaction before March 30, 2006.
