Blueair, Inc. of Chicago, IL, U.S. has obtained a temporary restraining order against MJC America, Ltd., of El Monte, CA, U.S., barring further manufacture, marketing, advertising, shipping, distributing, and sale of its SoleusAir Model SA-550 Air Purifier due to its similar appearance to Blueair’s Model 501 air purifier.
Blueair's sworn lawsuit in the Federal Court asserts that its trade dress rights in its Blueair Model 501 Room Air Purifier are violated by the similar-appearing SoleusAir Model SA-550 unit.
In the lawsuit, Blueair also objects that written materials describing its Model SA-550 unit, claiming that the materials contain false and misleading statements.
The restraining order, awarded on March 30, 2004, has been extended to June 10, 2004 through an April 12, 2004 agreement of the parties pending further rulings and attempted settlement.
Blueair President Bengt Rittri, states that Blueair's patented room air filter units are unique in their design, appearance, and performance and will be protected against such copying and other unfair competition.
