AHRI Sees Flaws in CPSC-Proposed Guidelines for Voluntary Recalls

The Air-Conditioning, Heating, and Refrigeration Institute (AHRI) sent comments on February 4 to the Consumer Product Safety Commission (CPSC) regarding CPSC's proposal to establish guidelines for voluntary recalls. AHRI said its comments expressed industry’s concern that the proposal would not improve the current voluntary remedial action process.

AHRI believes the proposed guidelines would adversely affect a program that has been effective and successful.

Among the problems, according to AHRI:
• The proposed changes would discourage the use of voluntary corrective action plans (CAPs) by making them mandatory.
• More interaction with CPSC would be required with the added provisions that CPSC proposed, and this would delay the implementation of CAPs or other voluntary remedial actions.

Overall, AHRI said, its comments "questioned the rationale for the proposal, which claims that the Commission requires legal tools to force compliance with voluntary recalls, as some firms do not comply with the CAP that was submitted to CPSC."
