Mertik Maxitrol Lawsuit Accuses Honeywell of Counterfeiting Gas Appliance Valve

Mertik Maxitrol alleged in a new lawsuit that Honeywell is manufacturing unauthorized copies of Mertik Maxitrol’s GV30 gas valve in China and is selling the counterfeit component, V5475, in France, Belgium, the Netherlands, Luxembourg, and Eastern Europe.

Mertik Maxitrol filed the lawsuit on June 22, 2010, alleging that Honeywell infringed its copyright of the GV30 gas valve, as well as engaging in unfair competition, trade dress infringement, breach of contract, and violation of the Michigan Consumer Protection Act. The case was filed in the Eastern United States District Court of Michigan naming Honeywell International Inc., USA; Honeywell Sarl, Switzerland; and Honeywell B.V., Netherlands as defendants in the complaint.

Mertik Maxitrol also said the Honeywell V5475 counterfeit is inferior in quality to Mertik Maxitrol’s GV30 gas valve.

The GV30 valve for gas-fired heating appliances was previously sold by Honeywell under the product designation of V5474. Mertik Maxitrol said the Honeywell V5475 looks similar to the GV30 (V5474) gas valve with only minor differences.

Mertik Maxitrol said that the Honeywell V5475, unlike the Mertik Maxitrol GV30 (V5474), is not certified for sale in Europe or in any other country.

Mertik Maxitrol alleges that Honeywell’s continued sale of the V5475 component has caused confusion in the market and is likely to continue to mislead or deceive customers and members of the general public.
